The NFLPA recently produced a two-page assessment for players entitled ?The Economic Truth About The New NFL CBA.?
On Monday, in separate letters to all players and NFLPA-certified agents, NFLPA president Domonique Foxworth and outside counsel Jeffrey Kessler went into more detail regarding the gains made by players in the new labor deal.
Foxworth?s letter repeats the same bullet points from the two-page document, along with a fourth entry:? ?Elimination of two-days and reduced hitting in practices have provided an immediate benefit to players.?
Also citing the higher Injury Protection Benefit and improved medical standard, Foxworth writes that ?the new CBA was something that was worth fighting for.?
Kessler?s letter is far more detailed, outlining nine arguments aimed at countering ?anti-player critics? who have made ?grossly inaccurate? claims that ?demonstrate a fundamental misunderstanding? of the current CBA and its predecessor.
His points are accurate, even though some of the issues weren?t ever the subject of serious criticism.? For example, Kessler claims that critics believe the current deal is unfair because it reduced the players? share from ??nearly 60%? to an average of 47% during the course of the deal.?? Though we?re aware of no critics who have made that contention, Kessler?s response is accurate.? The prior percentage was applied after the NFL received $1 billion off the top in cost deductions.? The new percentage is much, much closer to a per-dollar formula.
Kessler also points out that the new CBA has minimum cash spending requirements.? Though he doesn?t mention that the per-team minimum of 89 percent doesn?t apply until 2013, he accurately points out that the league-wide minimum is 99 percent in 2011 and 2012, dropping to 95 percent in future years.
Kessler also touts the increase in guaranteed compensation, addresses the belief in some circles that the 55-percent share that goes to the players on national TV and media deal is nevertheless limited by a 47-percent share on all revenue, defends the rookie wage scale, explains that the NFLPA did not surrender group licensing rights to the NFL, and emphasizes the non-economic benefits of the new CBA (such as limited practices, the new Injury Protection Benefit, and other achievements).
Finally, Kessler tackles the contention from a ?select number of ?journalists?? that ?the new CBA is not much better than the proposal the owners made to the players in March of 2011,? calling that claim ?uninformed and wrong.?? He points out that the proposal offered a fixed cap with no upside, along with dramatically reduced TV revenues as of 2014, and that the March 2011 proposal lacked other key player-friendly terms that appeared in the final deal.
Kessler?s letter represents the first detailed effort to respond to criticism of the CBA, but at no point does he or Foxworth address the comments from owners like Robert Kraft that, under the current labor deal, the salary cap won?t increase significantly for the foreseeable future.? The comparisons by ?journalists? like Daniel Kaplan of SportsBusiness Journal and Greg Bedard of the Boston Globe (and, yes, me) of the final CBA to the March 2011 proposal arose directly from projections and calculations regarding the cap dollars under the final deal in comparison to the guaranteed cap dollars under the March 2011 proposal.? Until the claims from influential owners like Kraft and Bob McNair are addressed, Kessler?s letter can?t be regarded as complete, no matter how thorough it may otherwise appear to be.

(CBS News) WASHINGTON - Republican leaders are laying down a new challenge to President Obama and Democrats over tax cuts and the national debt.
That could mean another ugly confrontation is coming, just in time for the November election.
The two parties are still fighting over the fallout from the last debt debate.
And now, House Speaker John Boehner (R, Ohio) is drawing a new line in the sand, making another showdown over the debt almost inevitable.
Boehner issued the warning Tuesday, declaring, "We shouldn't dread the debt limit. (As a) matter of fact, I think we should welcome it."
Boehner sets up another debt limit fightBoehner says Republicans won't allow another increase in the nation's debt limit unless it's offset by spending cuts, and no tax increases.
"Allowing America to default on its debt would be irresponsible," he said.
The nation's debt has nearly tripled in the past decade, and now stands at $15.6 trillion.
Treasury Secretary Timothy Geithner has predicted the U.S. will hit its current borrowing limit of $16.4 trillion by the end of the year.
Congress will have to raise that limit to avoid a damaging default on the nation's debt payments.
On the campaign trail, Mitt Romney echoed Boehner's hard line, saying, "Washington has been spending too much money, and our new president made things worse."
This is the second time Republicans are demanding deep cuts in exchange for their vote to raise the debt limit.
Last summer, a "grand bargain" between Speaker Boehner and the president to cut trillions from the debt fell apart. After weeks of bitter fighting, the two parties passed a bill to prevent default, but still triggered a downgrade of U.S. credit.
Democrats argue Boehner's latest comments don't bode well for compromise this time.
"The American people have had enough of this brinkmanship. They want us to get things done," says Senate Majority Leader Harry Reid (D, Nev.)
Virginia's Mark Warner, a Democrat, is part of a bipartisan group that's trying to build support from both sides for a mix of entitlement reforms, spending cuts, and new revenue from taxes.
"I spend a lot of time talking with my colleagues who know in their gut we've gotta do this," Warner says.
Former President Clinton spoke at the same economic forum as Boehner Tuesday and said he's optimistic that, after the November elections, the two sides will have more incentives to compromise on the debt limit lid.

In a press briefing held in advance of President Obama?s appearance in Reno, Nevada, Housing and Urban Development (HUD) Secretary Shawn Donovan gave a preview of the home refinancing aspects of the President?s ?To Do List? for Congress which he will be discussing further this afternoon.? Donovan also provided updates on the results of last fall?s executive refinancing initiatives.
Donovan said that last October, ?the President had included proposals to increase refinancing in the jobs plan he submitted to Congress.? Ordinarily, the Secretary said, the economy would be receiving an enormous boost from the record low interest rates so refinancing is a critical step in realizing this.? When Congress did not act on the jobs bill the President asked administration officials to identify what could be done without Congressional action to remove barrier to refinancing.? Within six weeks, Donovan said, five barriers were identified and the administration moved to remove or mitigate them.
The result has been a 50 percent increase in refinancing applications, roughly one in three of which is for a HARP loan, up from one in ten a year ago.? The increase has been even greater in areas hardest hit by price declines and foreclosures.? According to data from the Mortgage Bankers Association, refinancing applications are up 240 percent in Nevada, 180 percent in Arizona, and 125 percent in Florida and informal surveys suggest that two of every three refinancing applications in the hardest hit states are for HARP loans.
In January?s State of the Union Address the President laid out the final steps aimed at those borrowers who are doing everything right but still cannot refinance and this week there were three bills introduced in Congress to implement the rest of the President?s program.? The first, introduced by Senators Menendez and Boxer, would remove the barriers remaining for some 12 million borrowers with government-backed mortgages.? The legislation would help borrowers with second liens, cut red tape and costs such as eliminating manual appraisals, and would increase competition.
