Madoff indirect investors lose U.S. court appeal

(Reuters) - People who lost money by investing in funds that funneled their money to Bernard Madoff's Ponzi scheme are not entitled to recover for their losses, in the manner that direct victims of the massive fraud can recover, a federal appeals court ruled on Friday.

The decision by the 2nd U.S. Circuit Court of Appeals in New York is a victory for Irving Picard, the trustee liquidating Bernard L Madoff Investment Securities LLC and seeking money for its former customers.

Picard, a partner at Baker & Hostetler, persuaded the court that "indirect" investors who lost money in the fraud were not Madoff customers who could recover from the bankruptcy estate.

Madoff, 74, is serving a 150-year prison sentence, and Picard had estimated that customers lost $17.3 billion of principal in the fraud.

The appeal was brought by 17 investors who had invested in limited partnerships known as Spectrum Select. These in turn sent their money to two Rye Select hedge funds overseen by Tremont Group Holdings Inc.

Tremont was one of the largest Madoff "feeders," and settled with Picard for $1.025 billion in July 2011.

Prior to the appeal, two lower court judges had found that the 17 indirect investors could not recover from the estate because they had not been Madoff customers, unlike the feeder funds that dealt directly with him.

That distinction matters because it is customers, not indirect investors, who may draw up to $500,000 each from a fund overseen by the Securities Investor Protection Corp, to the extent they cannot recover losses from a bankruptcy estate.

SIPC is a nonprofit created by Congress and funded by the brokerage industry.

CRITICAL REQUIREMENT NOT SATISFIED

Writing for a three-judge 2nd Circuit panel, Circuit Judge Reena Raggi said there were several reasons that the indirect investors did not qualify as Madoff customers.

She said they had no direct relationship or accounts with his firm, were not identified in the firm's books and records, had no property interest in the assets sent there by the feeder funds, and lacked control over the feeder funds' investments.

"We have identified the critical aspect of the 'customer' definition to be the entrustment of cash or securities to the broker-dealer for the purpose of trading securities," Raggi wrote. "Appellants fail to satisfy this critical requirement."

William Chapman, who argued the indirect investors' appeal, did not immediately respond to a request for comment.

A spokeswoman for Picard did not immediately respond to a similar request.

The decision does not affect the ability of indirect investors to sue the feeder funds, or share in any recovery by those funds from the SIPC fund.

Friday's decision is the second this week by the 2nd Circuit in a Madoff-related appeal.

On Wednesday, the court refused to let former investors pursue claims against Madoff's brother Peter, as well as Madoff's son Andrew and the estate of his late son Mark, over the family members' roles in the fraud.

The court said allowing such claims would impede Picard's effort to maximize payouts from the estate.

Among the investors who had challenged the trustee was a charitable foundation for New Jersey Senator Frank Lautenberg.

Separately, Picard on February 13 asked U.S. Bankruptcy Judge Burton Lifland in Manhattan for permission to distribute another $505 million to customers, boosting the total to $5.44 billion.

The case is Kruse et al v. Securities Investor Protection Corp et al, 2nd U.S. Circuit Court of Appeals, Nos. 12-410, 12-437, 12-483 and 12-529.

Show with Pistorius' dead girlfriend to go ahead

JOHANNESBURG (AP) ? South Africa's national broadcaster says it will screen a reality TV show featuring the dead model girlfriend of Oscar Pistorius, two days after she was shot and killed at the home of the double-amputee athlete.

In a statement Saturday, SABC confirms it will air the Tropika Island of Treasure program "which features the late Reeva Steenkamp."

Pistorius has been arrested and charged with the Valentine's Day murder of Steenkamp, who was shot multiple times in the predawn hours of Thursday at Pistorius' house in a gated community in the South African capital, Pretoria.

The show's executive producer, Samantha Moon, tells The Associated Press that Steenkamp's family wants the show to go ahead. Moon says that the family "wants it on. This is how they want to remember her."

The NFLPA recently produced a two-page assessment for players entitled ?The Economic Truth About The New NFL CBA.?

On Monday, in separate letters to all players and NFLPA-certified agents, NFLPA president Domonique Foxworth and outside counsel Jeffrey Kessler went into more detail regarding the gains made by players in the new labor deal.

Foxworth?s letter repeats the same bullet points from the two-page document, along with a fourth entry:? ?Elimination of two-days and reduced hitting in practices have provided an immediate benefit to players.?

Also citing the higher Injury Protection Benefit and improved medical standard, Foxworth writes that ?the new CBA was something that was worth fighting for.?

Kessler?s letter is far more detailed, outlining nine arguments aimed at countering ?anti-player critics? who have made ?grossly inaccurate? claims that ?demonstrate a fundamental misunderstanding? of the current CBA and its predecessor.

His points are accurate, even though some of the issues weren?t ever the subject of serious criticism.? For example, Kessler claims that critics believe the current deal is unfair because it reduced the players? share from ??nearly 60%? to an average of 47% during the course of the deal.?? Though we?re aware of no critics who have made that contention, Kessler?s response is accurate.? The prior percentage was applied after the NFL received $1 billion off the top in cost deductions.? The new percentage is much, much closer to a per-dollar formula.

Kessler also points out that the new CBA has minimum cash spending requirements.? Though he doesn?t mention that the per-team minimum of 89 percent doesn?t apply until 2013, he accurately points out that the league-wide minimum is 99 percent in 2011 and 2012, dropping to 95 percent in future years.

Kessler also touts the increase in guaranteed compensation, addresses the belief in some circles that the 55-percent share that goes to the players on national TV and media deal is nevertheless limited by a 47-percent share on all revenue, defends the rookie wage scale, explains that the NFLPA did not surrender group licensing rights to the NFL, and emphasizes the non-economic benefits of the new CBA (such as limited practices, the new Injury Protection Benefit, and other achievements).

Finally, Kessler tackles the contention from a ?select number of ?journalists?? that ?the new CBA is not much better than the proposal the owners made to the players in March of 2011,? calling that claim ?uninformed and wrong.?? He points out that the proposal offered a fixed cap with no upside, along with dramatically reduced TV revenues as of 2014, and that the March 2011 proposal lacked other key player-friendly terms that appeared in the final deal.

Kessler?s letter represents the first detailed effort to respond to criticism of the CBA, but at no point does he or Foxworth address the comments from owners like Robert Kraft that, under the current labor deal, the salary cap won?t increase significantly for the foreseeable future.? The comparisons by ?journalists? like Daniel Kaplan of SportsBusiness Journal and Greg Bedard of the Boston Globe (and, yes, me) of the final CBA to the March 2011 proposal arose directly from projections and calculations regarding the cap dollars under the final deal in comparison to the guaranteed cap dollars under the March 2011 proposal.? Until the claims from influential owners like Kraft and Bob McNair are addressed, Kessler?s letter can?t be regarded as complete, no matter how thorough it may otherwise appear to be.
